Sherpace guarantees and respects your privacy and will only process your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable laws and regulations in the manner and for the purposes described below.

When do we collect your personal data?
We collect your data from the moment you provide your details on our website, send information to or share it with one of our employees, or otherwise register your details or notify us that you wish to use our services. We may also collect information from publicly available sources that could indicate you are interested in work-related services. In such cases, we will contact you to confirm whether you are interested in registering with us, in line with our conditions and with due observance of this privacy statement.

Why do we collect your personal data?
We collect and process your data for the purpose of executing our services. More specifically, your personal data is processed:
• for you as a business relation, to maintain this business relationship, provide offers and/or information about services and other activities, align them with your preferences and qualifications, conclude and maintain an agreement, or invite you to events that may be of interest to you. If you do not wish to receive mailings, you can opt out at any time;
• if you are a candidate, to assess your suitability and availability in connection with mediation for permanent or temporary work or an assignment, which may include test results, reference checks, social media, etc.;
• if you are going to work / currently work / have worked for Sherpace:
– to enter into and maintain an employee or personnel/broker relationship with you and carry out the related administration,
– to record an assignment with a client in an agreement and to maintain and fulfil that contract,
– to promote your personal development and employability, including training, education and testing,
– for compliance with laws and regulations, including but not limited to identification, labour law, tax and social security legislation, fraud prevention, and national and international sanctions legislation.

What personal information do we collect?
We process the personal data necessary for our services; part of this is required to use our services. Additional information may be desirable to better tailor the services to your preferences or to meet client obligations. You are responsible for the accuracy and relevance of the information you provide. This includes (among others):
• business relations: name, gender, contact details and function;
• candidates: address, residence, date of birth, CV, training, internships, work experience, availability, leave, skills and expertise, test results, references, certificates;
• employees/contractors: nationality, social security number, ID certificate, work permit, and other data related to staff, salary and absenteeism registration.

How long do we keep your personal data?
Retention periods depend on applicable statutory requirements:
• Business relations: up to 2 years after the last contact. On request, your data will be anonymised earlier.
• Candidates (not yet employed): up to 2 years after the last contact. If you withdraw your consent, your data will be anonymised.
• Employees/contractors: up to 2 years after termination of employment/deployment. Some records must be kept longer by law:
– Payroll administration data: 7 years;
– Payroll tax statements: 5 years;
– Copy of proof of identity: 5 years.

Sharing your personal data
Sherpace only provides personal data to third parties if necessary for the execution of an agreement, for mediation purposes, or to comply with a legal obligation. Data may be transferred outside the Netherlands where required, with appropriate safeguards to ensure protection.

Your rights – access and/or changes

Security
Sherpace takes all reasonable measures to protect your personal data from unauthorised use, including physical, administrative, organisational, and technical safeguards. Only authorised persons have access to data. Service providers processing data on our behalf are contractually obliged to provide adequate protection.
